IN THE NEWS: R699 car class action suit fails

In what has probably come as a great blow to thousands of motorists who participated in the now collapsed R699 per month car finance scheme, the Port Elizabeth High Court recently dismissed a bid for certification of a class action suit by the thousands of affected consumers against the company behind the scheme. The Court apparently held that there was absolutely no cause of action reflected in the certification papers and that the application was based merely on “conjecture and assertions.” In fact, the Court was apparently so scathing of the application, that it ordered the attorney representing the consumers to pay for the legal costs of bringing the application. One has to wonder whether a different judge may not have focused a bit more on the plight of the thousands of motorists who suddenly cannot afford their car finance instalments rather than just lambasting their attorney for poorly drafted papers.
